These Terms & Conditions (“Terms”) govern your use of the websites, programs, services, workshops, coaching, memberships, digital content, and other offerings provided by Goldberg Services, Inc., doing business as Rachel Bailey (“we,” “us,” or “our”).

By accessing our website, purchasing or participating in any of our offerings, or using our materials, you agree to these Terms.

1. Educational Purposes Only

Our programs, coaching, workshops, resources, and other content are intended for educational and informational purposes.

Although Rachel Bailey has professional experience in the mental health and parenting fields, participation in our programs or use of our materials does not establish a therapist-client, doctor-patient, or other healthcare provider relationship.

Our services are not psychotherapy, medical care, diagnosis, or treatment and are not intended to replace individualized advice or treatment from a qualified medical or mental health professional.

If you have concerns about your own or your child's physical or mental health, you should consult an appropriate qualified professional.

2. Eligibility

Our services and products are intended for adults age 18 and older. By purchasing or participating in an offering, you represent that you are at least 18 years old and legally able to enter into these Terms.

3. Payment

You agree to pay the price presented at the time of purchase.

Some programs may offer the option to pay the purchase price in installments. An installment plan is a payment arrangement for the full purchase price and is not a month-to-month membership.

If you select an installment payment plan, you remain responsible for all scheduled payments, even if you stop participating in or using the program before the payment plan is complete.

Stopping participation, failing to access program materials, or choosing not to use the services provided does not cancel your remaining payment obligation.

4. Memberships and Recurring Subscriptions

Certain offerings may be structured as ongoing memberships or subscriptions.

Unless otherwise stated at the time of purchase, these memberships may be canceled at any time. Cancellation stops future recurring charges but does not provide a refund for payments already made.

Cancellation of an ongoing membership is different from discontinuing participation in a fixed-price program being paid through an installment plan. Installment payments for a fixed-price program remain due as described above.

5. Refund Policy

All purchases are final and non-refundable unless otherwise expressly stated in writing for a specific offer at the time of purchase or unless you qualify for a guarantee expressly applicable to your purchase under Section 6 below.

We do not provide refunds because you change your mind, do not complete a program, do not use the materials or services available to you, or decide that an offering is no longer a good fit.

Any exception, guarantee, or different refund policy specifically stated on an offer's sales or checkout page or elsewhere in these Terms will govern that purchase.

6. Results and Guarantee
We are committed to providing high-quality educational programs, resources, and support. Every parent, child, and family is different, and except for a specific written guarantee expressly applicable to an offering, we do not guarantee any particular result from participating in our programs, coaching, workshops, memberships, or other offerings.

Examples, testimonials, and descriptions of results experienced by others are provided for illustrative purposes and do not guarantee that you will achieve the same or similar results. Your results may depend on many factors, including your individual circumstances, participation, implementation, and factors outside our control.

The Confident When It’s Hard program is subject to the following limited 90-Day Results Guarantee:

(a) 90-Day Results Guarantee

Subject to this Section 6, we guarantee that within ninety (90) days of your purchase of the Confident When It’s Hard program (the “Program”), you will experience at least a fifty percent (50%) reduction in the frequency of your child’s meltdowns or big reactions, as measured against the baseline you report at the beginning of the Program (the “Guarantee”).

The Program is designed for parents and caregivers of children ages 3–13 who experience frequent big reactions to everyday challenges, including frustration, limits, transitions, anxiety, demands, tasks, disappointment, and other uncomfortable situations.

The Program teaches parents strategies for changing how they respond to these situations and for helping their children build the skills to handle discomfort more effectively.

The date that is ninety (90) days after your purchase of the Program is the “Guarantee Date.”

If you are dissatisfied with your results as of the Guarantee Date, have not achieved the improvement described above, satisfy all of the eligibility requirements in this Section 6, and timely exercise the Guarantee as described below, you will be entitled to a refund of all amounts you have actually paid toward the Purchase Price of the Program. If you are participating under an installment payment plan, any remaining scheduled installment payments will be canceled and you will have no further payment obligation for the Program.

Failure to achieve the guaranteed result does not automatically result in a refund. To receive a refund under the Guarantee, you must be dissatisfied with your results and affirmatively request to exercise the Guarantee in accordance with this Section 6.

Nothing in this Guarantee is a promise that your child will never experience another meltdown, big emotion, or difficult reaction. For purposes of the Guarantee, the promised result is measured by the reduction in frequency described above.

(b) Eligibility for the Guarantee

You qualify for and are entitled to exercise the Guarantee only if:

A. At least ninety (90) days have elapsed since your purchase of the Program, and no more than fourteen (14) days have elapsed since the Guarantee Date;

B. You are dissatisfied with the results you have achieved through the Program and affirmatively request to exercise the Guarantee within the time period stated above;

C. You completed the initial assessment at the beginning of the Program, including providing the requested baseline information regarding the frequency of your child’s meltdowns or big reactions;

D. You complete the final assessment required to exercise the Guarantee, and that assessment demonstrates that the frequency of your child’s meltdowns or big reactions has not decreased by at least fifty percent (50%) compared with your initial baseline;

E. You have completed the core Program lessons and corresponding Action Plans, including the required work related to Connection, Confidence, and Consistency and the applicable child-skills portion of the Program;

F. You have made a good-faith effort to implement the strategies identified in your Action Plans for the recommended periods of time and have made reasonable adjustments based on coaching and feedback provided to you through the Program;

G. You have participated in the individual coaching sessions included as part of your Program that occur before the Guarantee Date, unless a session was unavailable or canceled by us;

H. If you were not experiencing sufficient progress during the Program, you contacted us as required under subsection (c) below, provided us with an opportunity to review your situation and recommend adjustments, and made a good-faith effort to implement those recommended adjustments;

I. All payments due under your payment plan, if applicable, have been made on time through the date on which you exercise the Guarantee; and

J. You have not otherwise breached these Terms and Conditions.

Attendance at optional group Q&A sessions or case study sessions, and completion of optional weekly check-ins, are not required to qualify for the Guarantee.

(c) Requesting Support Before the Guarantee Date

If you do not believe you are making sufficient progress toward reducing the frequency of your child’s meltdowns or big reactions, you must contact us no later than sixty (60) days after your purchase of the Program and let us know that you are not progressing as you had hoped.

We will use this opportunity to review your progress, Action Plans, strategies you have implemented, and obstacles you are experiencing and may recommend reasonable adjustments to your plan.

To remain eligible for the Guarantee, you must make a good-faith effort to implement the reasonable adjustments recommended through this review. Failure to contact us by Day 60 when you are not making sufficient progress, or failure to make a good-faith effort to implement the recommended adjustments, will make you ineligible to exercise the Guarantee.

(d) Exercising the Guarantee

If you are dissatisfied with your results as of the Guarantee Date and believe you meet the requirements above, you must notify us in writing that you wish to exercise the Guarantee no later than fourteen (14) days after the Guarantee Date.

As part of your request, you must complete the final assessment and participate in one final results-review session with us. During that session, we will review your results, your implementation of the Program, and any remaining obstacles.

We may identify additional strategies or adjustments that could help you achieve the desired result. You may choose whether you wish to continue working toward the result. You will not be required to continue participating in the Program or implementing additional strategies as a condition of receiving a refund if you have otherwise satisfied the requirements of this Guarantee.

If you satisfy all requirements of this Section 6 and elect to exercise the Guarantee following the results-review session, we will refund all amounts you have actually paid toward the Purchase Price of the Program. If you are participating under an installment payment plan, any remaining scheduled installment payments will be canceled and you will have no further payment obligation for the Program.

We are committed to providing high-quality educational programs, resources, and support. However, every parent, child, and family is different.

We do not guarantee any particular result from participating in our programs, coaching, workshops, memberships, or other offerings.

7. Intellectual Property

Unless otherwise stated, all materials provided through our website and offerings—including videos, audio recordings, lessons, worksheets, frameworks, graphics, written materials, downloads, presentations, and other content—are owned by or licensed to Goldberg Services, Inc. and are protected by applicable intellectual property laws.

Your purchase gives you a limited, personal, non-transferable right to use the materials for your own personal use.

You may not, without our prior written permission:

Copy or reproduce our materials for distribution;

Share purchased materials or login credentials with others;

Sell, sublicense, or redistribute our materials;

Publish or post our materials publicly;

Use our materials to create or provide your own course, program, training, or commercial service; or

Represent our proprietary materials, frameworks, or content as your own.

8. Community Participation and Conduct

Some of our programs may include access to group calls, online communities, discussion forums, or other spaces where participants interact.

We want these spaces to remain respectful and useful for participants. You agree not to engage in abusive, threatening, harassing, discriminatory, disruptive, or otherwise inappropriate conduct.

You also agree to respect the privacy of other participants and not to share another participant's personal information, stories, posts, comments, or other information outside the group without that person's permission.

We reserve the right to limit or terminate a participant's access to a community, group, program, or service when we reasonably determine that their conduct is harmful, disruptive, inappropriate, violates these Terms, or interferes with the experience or safety of others.

Removal for violation of these Terms does not entitle the participant to a refund or eliminate outstanding payment obligations.

9. Participant Privacy in Group Programs

Because some services involve group participation, we cannot guarantee that other participants will maintain confidentiality.

We ask all participants to respect one another's privacy, but you should use your own judgment when deciding what personal or sensitive information to share in a group environment.

10. Availability and Changes to Offerings

We may occasionally make reasonable changes to program schedules, content, instructors, features, platforms, or delivery methods.

We may also reschedule or cancel individual sessions, workshops, or events when necessary.

We will make reasonable efforts to provide the core services and content associated with your purchase, but we do not guarantee that every feature, session, resource, or delivery method will remain unchanged.

11. Third-Party Services and Links

Our websites and programs may use or link to third-party platforms, websites, software, payment processors, or other services.

We are not responsible for the content, availability, security, privacy practices, or operation of third-party services.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Goldberg Services, Inc., Rachel Bailey, and their employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or participation in our websites, programs, services, or materials.

To the fullest extent permitted by law, our total liability for any claim relating to an offering will not exceed the amount you paid to us for the specific offering giving rise to the claim.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited or waived.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page.

Your continued use of our website or services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
